It was reported that Xiao Zou, who was only 18 years old, did not wait until the two trial and decided to die of severe blood disorder.



Xiao Zou came from Hubei and worked in a shoe factory in Wenzhou in 2008. Then he suffered from chronic severe benzene poisoning.

After she fell ill, she brought her employer Kim to court.

The court of first instance decided in Lucheng to compensate Mr. Xiao Zou 460 thousand.



Kim refused to accept the case and entered the second instance.

During the trial, Xiao Zou died of illness, and the Wenzhou intermediate people's court dismissed the original decision.

Yesterday, the Lucheng court heard that after hearing the case again, Kim decided to compensate Xiao Zou's parents for a total of 690 thousand yuan.

At that time, her face was pale, because she had no money to stay in hospital, and her mother squeezed in a room with three plywood separated, only seven or eight square meters.



Xiao Zou recalled that on March 14, 2008, she joined her mother and elder sister in a shoe factory in Lucheng, and worked in a car bag.



In May 19th, she suddenly felt weak and then fell to the ground.



Xiao Zou went to the hospital for examination. The diagnosis was chronic severe benzene poisoning (aplastic anemia).

After reporting to Wenzhou CDC, Xiao Zou was finally confirmed that his illness constituted occupational disease.



At that time, all hope of Xiao Zou was entrusted to the court's decision.

After hearing the case in Lucheng, the court held that the employer should pay more than 460 thousand yuan for compensation.



However, Kim refused to accept the first instance and appealed.

The reason is that he worked in his factory for more than a month.

In such a short time, it will not cause illness.



Not until the two trial was decided, Xiao Zou died.



The Wenzhou intermediate people's court subsequently ruled that Xiao Zou died during the second instance hearing, and her parents were the first legal successor. She was willing to take part in the proceedings. The case could be ruled that the original judgment was withdrawn and sent back to Lucheng for retrial.



In the end, the court of Lucheng decided again that Kim had to compensate the parents of Xiao Zou for more than 69 yuan of medical expenses.

The reason for the court's decision is that Kim did not fulfill the obligation of occupational disease protection, which made Xiao Zou get sick and eventually died of the disease.

Lawyers say that occupational disease cases are hard to fight, and the biggest difficulty is "difficulty in obtaining evidence".

The key to the success of this case is that Xiao Zou was able to report the disease to the Department of disease control in time, and obtained the certificate of diagnosis, locking the evidence for the first time.
